Nusrat murder case and court observations
In 2019, the lower court of Feni sentenced all 16 accused to death in the much-discussed Nusrat Jahan Rafi murder case. However, the High Court recently made major changes in that verdict, upholding the death sentences of two, reducing the sentences and acquitting the rest. At the same time, the High Court expressed its strong dissatisfaction over the issue of awarding death sentences to 16 people indiscriminately without exercising sufficient judicial mind or consideration and termed it a 'mindless sentence'. Supreme Judicial Council: This constitutional body has the power to investigate allegations of incompetence or misconduct of high court judges and remove them.
Special powers of the High Court (Article 109): According to the Constitution, the High Court division has the special power to supervise and control all subordinate courts or tribunals. The High Court can take administrative or judicial action if there are allegations of irregularities against lower court judges.
Role of the Ministry of Law: The Ministry of Law can also take appropriate action based on various allegations against judicial court judges. According to experts, it is very important for judges to perform their duties completely impartially and legally, avoiding the influence of emotions, media or social media in giving judgments.
